E-law’s growing importance for all

With the ever increasing use of the internet by individuals and firms and daily growth in transactions on the internet, the need for legal assistance by all is becoming more of a reality.

There are various areas which are becoming of greater concern to all who utilise the internet, of which privacy and security of information are probably the two areas of greatest concern. Intellectual property is the area which is under the greatest amount of threat by the internet, however, there are also difficulties associated with contracting and liability of delict on the internet. Further, problems arise with regard to dispute resolutions and which country’s laws are applicable and which court or organisation has the jurisdiction to consider such disputes.

In an attempt to regulate this situation the South African government has proposed the Electronic Communications and Transactions Bill which has as its preamble:

“To provide for the facilitation and regulation of electronic communications and transactions; to provide for the development of a national e-strategy for the Republic; to promote universal access to electronic communications and transactions and the use of electronic transactions by SMME’s; to provide for human resource development in electronic transactions; to prevent abuse of information systems; to encourage the use of e-government services; and to provide for matters connected therewith.”
